Can step-parent cover step kids under their med insurance?

I live in MN. I am able to cover my husbands son (my step son) under our insurance at work which is Medica. He is unable to do so with his insurance which is Health Partners and his Dental plan as well (for my children). His employer told him he would have to adopt them in order to be insured. Is this correct? Do employers/insurance companies have the final say in what they allow? Is it up to the discretion and contract of the employer and insurance company? Having a hard time finding info on this.

Since the employer is providing the health insurance, they set the rules for eligibility. Yes, they may require that he adopt the children. Most often it depends on who has custody, but they may require adoption. You should ask the employer to provide you (in writing) the rules for eligibility-just for you own peace of mind. The carrier should also be able to provide you with this info.
